Reporting Obligations

As a UC employee, you may have certain obligations to report what you learn about incidents of violence, abuse, neglect, discrimination and harassment, or other conduct that could be a violation of the law and/or University policy. The chart below is meant to help you understand when you are required to report a concern, how to report the concern, and where to find more information.

If someone approaches you to talk about a difficult experience they had, it is important to respond with care and concern:

  • Listen actively and respond without blame, doubt, or judgment. Please do not attempt to investigate. 
  • Let them know about your reporting obligations. 
  • Connect the person with resources so they can get support and understand their rights and options.

Please be aware that you may have to report the same incident to multiple offices due to overlapping reporting obligations you may hold. Anyone who witnesses or experinces harm is encouraged to report it, not just people who are required to make a report. 

Please report any disclosed, witnessed, or suspected harm, even if you are unsure you are required to report it. For concerns that don't fit into one of these categories, you can use the Whistleblower Hotline(link is external).

Sexual violence and sexual harassment

The Office for the Prevention of Harassment and Discrimination (OPHD):

All non-confidential employees (including student employees) must report incidents experienced by students

Faculty, managers, and supervisors must report incidents experienced by anyone affiliated.

Discrimination and harassment on the basis of Protected Categories

Office for the Prevention of Harassment and Discrimination (OPHD):

Non-confidential faculty, managers, and supervisors must report incidents experienced by anyone affiliated.

Abusive conduct in the workplace (e.g. bullying)  Employee and Labor Relations online report form(link is external). Managers and supervisors (including Deans and Chairs)
Clery crimes(link is external) that you witnessed or that were reported to you (including but not limited to burglary, robbery, motor vehicle theft, rape, dating or domestic violence, stalking (with romantic/sexual motivation or non-romantic/sexual motivation), hazing, and hate crimes)

If there is a serious or ongoing threat, please call 911 or report to UCPD(link is external) immediately. 

All other crimes may be reported to the Clery Division(link is external) using the CSA Reporting Form(link is external).

Anyone is encouraged to report criminal activity to law enforcement, such as UCPD at UC Berkeley. 

Includes but is not limited to offices and individuals (employees or non-employees):

  • Responsible for campus security
  • Designated to receive crime reports
  • With significant responsibility for student & campus activities (e.g. Registered Student Organization advisors, athletic coaches, Resident Assistants)
Child abuse or neglect you observed or suspect and any imminent threats of harm to minors

Please take all of the following steps:

  1. Immediately notify police (UCPD: 510-642-6760) & your supervisor.
  2. Submit a report to the University Whistleblower Hotline (link is external)
  3. Submit a CANRA Report (PDF file)(link is external) within 36 hours to authorities

Individuals whose duties include:

  • Direct or indirect contact with minors
  • Supervision of minors
  • Supervision of other Mandated Reporters or employees who come into regular contact with minors
  • Volunteers who come into regular contact with minors
  • Ancillary staff who work in areas where minors are regularly present
Workplace violence 

Submit a ELR HR Service Hub ticket(link is external)(link is external) via the Employee & Labor Relations website. 

  • Anyone is encouraged to make a report of workplace violence.
  • Managers and supervisors *must* report workplace violence that they become aware of.
  • Employers must immediately report to Cal/OSHA any work-related death or serious injury or illness.
Improper governmental activity (including but not limited to fraud, bribery, the theft or misuse of University resources) 

UC Whistleblower Hotline:

Managers, administrators and employees in supervisory roles must promptly report the matter to their supervisor and the Whistleblower Hotline.
